One of the most common questions we get asked here at Dishon & Block is whether spousal support must be paid forever. Many people had been married for decades and after divorce were made to pay significant monthly alimony or spousal support payments. We often hear stories of how previous legal counsel told them they would have to pay for years and perhaps even decades with no hope for termination or even reduction.
Well, we’re here to tell you this is not the case. California state law dictates that spousal support is not permanent! In fact, depending on circumstance it might only last a few years. In other cases, it can last for decades; but often the amount paid can be reduced significantly.

Also known as “alimony” and “maintenance,” spousal support is a financial obligation many would rather not face. But in California, it is mandated law. It is the obligation for one spouse to provide the other spouse with financial support upon marital separation.
- What is an Order to Show Cause Hearing?

When starting the divorce process in California, you may hear the phrase Order to Show Cause used quite frequently. An Order to Show Cause is a hearing that typically takes place in between filing for a divorce and the final divorce decree. Typically, the Order to Show Cause hearing is set to handle issues that are too important to wait until the actual trial. These orders will temporarily settle child custody, child or spousal support, and also protective orders keep people safe from harm while awaiting the divorce trial. While these are the most common uses of the Order to Show Cause hearing, there is one other that you should be aware of. - Hire a hit man to murder your spouse, go directly to jail. . Do not collect $200.00!!

Schwarzenegger Approves Spouse Protection Bill

Governor Arnold Schwarzenegger has signed a bill to protect men and women from vengeful spouses. The governor on Friday signed AB2674 by Assemblyman Marty Block, a Democrat from San Diego. It says that spouses who solicit the murder of their husband or wife are not entitled to collect benefits in divorce proceedings. The bill was inspired by the true-life story of a Pomona police detective, John Pomroy. His ex-wife collected about $70,000 from the couple’s estate after she was convicted of soliciting a hit man to murder him in 2003.
Until now, California’s no-fault divorce code was silent on such efforts. A couple’s shared assets are usually split evenly during a divorce. The bill takes effect in January.
