Courts Have the Power to Restrict Parents Speech
AN ORDER RESTRAINING A PARENT FROM “INTERFERING” WITH THE OTHER PARENT’S PARENTING TIME IS NEITHER AMBIGUOUS NOR UNCONSTITUTIONALLY OVERBROAD.
In family law cases, courts have the power to restrict speech to promote the welfare of the children.

In a recent divorce and child custody case the Husband asked the court to issue a restraining order preventing Wife from interfering with his custodial time. Husband complained that Wife told the children every detail of the trial, told them that he lied to the court and told them they do not have to follow the court’s orders. She also told the children their father lied to reduce his child support obligation. In October 2007, after an evidentiary hearing, the trial court found Wife treated the court orders as if they were a “work in progress.”

Divorce Clustering – Are You at Risk?
The increased incidence of divorce among those whose friends or family are divorced.
According to a new study, reported by Tracy McVeigh in The Observer, divorce is catching:
The researchers have called it “divorce clustering” and say that a split up between immediate friends increases your own chances of getting divorced by 75%. The effect drops to 33% if the divorce is between friends of a friend, what the researchers call two degrees of separation, then disappears almost completely at three degrees of separation. It is not only the marital status of friends but also siblings and colleagues which has a significant effect on how long your own marriage might last. Breaking up will catch on among your friends, and the more divorcees you know, the higher your own chances of becoming one.
The research comes from sociologists and psychologists from three North American universities who have examined statistics from a group of individuals over a 32-year period. They looked at the effect of divorce among peer groups on an individual’s own risk of divorce and found a clear process of what the scientists called “social contagion.” The study was carried out by academics Rose McDermott at Brown University, James Fowler at the University of California and Nicholas Christakis at Harvard.

Schwarzenegger Approves Spouse Protection Bill

Governor Arnold Schwarzenegger has signed a bill to protect men and women from vengeful spouses. The governor on Friday signed AB2674 by Assemblyman Marty Block, a Democrat from San Diego. It says that spouses who solicit the murder of their husband or wife are not entitled to collect benefits in divorce proceedings. The bill was inspired by the true-life story of a Pomona police detective, John Pomroy. His ex-wife collected about $70,000 from the couple’s estate after she was convicted of soliciting a hit man to murder him in 2003.
Until now, California’s no-fault divorce code was silent on such efforts. A couple’s shared assets are usually split evenly during a divorce. The bill takes effect in January.
